Given that 953 was filed with full knowledge of PFE's compound, they made a strategic decision to file as they did. So I have no idea from a legal perspective if they should have done 953 differently or if what they did was the best available option under the circumstances. It's also possible they didn't anticipate an issue. Irrespective of that I think both 953 and 048 should be viewed as sloppy work.
